Marks & Spencer (M&S) and Aldi have confirmed that a settlement has been made over the former’s legal action against Aldi’s rival bug-shaped cake.

In April 2021, M&S began legal action against Aldi as it claimed that the German retailer had unlawfully copied its Colin the Caterpillar cake.

The dispute was settled in the British high court last week, however the details of the settlement have not been disclosed.

An M&S spokesman said: “The objective of the claim was to protect the [intellectual property] in our Colin the Caterpillar cake and we are very pleased with the outcome.”

Aldi indicated that Cuthbert, the rival cake, will make a return to supermarket shelves. The retailer tweeted: “Getting out early on good behaviour, keep an eye out for Cuthy B this Spring.”
